Terms of sale and license

1. Who does what

The Hipokamp app is published by BAAIR, SASU with a share capital of €5,000, 19 avenue de la Forge, 44500 La Baule-Escoublac, France, RCS Saint-Nazaire 829 515 410 ("BAAIR", "we").

Licenses are sold by Lemon Squeezy LLC, acting as reseller (Merchant of Record): the sales contract is concluded with Lemon Squeezy, which collects the payment, applies your country's VAT, issues the invoice and processes refunds. Its buyer terms apply to the payment. BAAIR grants you the license described below and provides support.

These terms apply to individuals and businesses alike. They never deprive a consumer of the rights granted by the law of their country of residence.

2. The offer

Requirements: macOS 14 or later. The embedded Node runtime is built for Apple Silicon; on an Intel Mac, the app uses the Node installed on the system. The app interface is in French. Claude Desktop and Claude Code are Anthropic products, not provided by BAAIR; their use is subject to your own subscriptions and terms.

3. Free trial

The app can be tried for 14 days, with every feature unlocked, no credit card and no account. When the trial ends, it becomes read-only: you keep access to your files, which remain ordinary Markdown files.

4. Order and delivery

You order on Lemon Squeezy's checkout page, reachable from the website or the app. Once payment is accepted, your license key is sent by email. The app is downloaded from hipokamp.baair.app; the key is activated in Settings ▸ License.

5. Refunds and right of withdrawal

You can request a full refund within 14 days of your order, with no justification, by writing to alexandre@baair.solutions or through the Lemon Squeezy customer portal. This period covers the statutory right of withdrawal, even after download and activation. Lemon Squeezy refunds the payment method you used; the license is then deactivated and the app returns to read-only mode.

6. License

BAAIR grants you a personal, non-exclusive, non-transferable right to install and use Hipokamp on up to two Macs, for personal or professional use. You agree not to:

Decompilation remains allowed within the limits set by law. Open source components included (such as the MCP server) remain under their own license, which prevails for those components. A license obtained fraudulently or used in breach of these terms may be deactivated.

7. Your data and files

Hipokamp works on the folders of your Mac. You remain the sole owner of your content and solely responsible for backing it up (Time Machine or any other means). The app never deletes your files because of the license: without a valid license, it becomes read-only. Personal data processing is described in the privacy policy.

8. Warranty and liability

For consumers, BAAIR is liable for lack of conformity of digital content under Articles L.224-25-12 et seq. of the French Consumer Code and the equivalent law of your country. If the app does not work as described, contact support: we fix it, or you are refunded.

Hipokamp works with third-party software and services (Claude Desktop, Claude Code, GitHub, Notion, calendars, publishing tools) that BAAIR neither operates nor controls. A change in those services may limit an integration feature; we do our best to adapt it in an update. For business customers, BAAIR's liability is limited to the price paid for the license, except in case of gross negligence or wilful misconduct.

9. Support

Support is provided by email at alexandre@baair.solutions, in French or English, on business days.

10. Mediation and governing law

If there is a dispute, write to us first: most problems are solved by talking. If you are a consumer and your written complaint is not resolved, you may use the consumer mediator free of charge: [mediator to be appointed by BAAIR: name, website, address].

These terms are governed by French law, without prejudice to the protective provisions of the law of the consumer's country of residence. Failing an amicable settlement, the competent courts are those designated by law; for business customers, the courts within the jurisdiction of the Rennes Court of Appeal.
